    Note on the US CLOUD Act

    Microsoft, AWS and Google are US corporations and are subject to the US CLOUD Act, even with data centres in Switzerland or the EU. This residual risk belongs in every risk assessment.

    The best solutions: three proven setups for property management

    Hardly any organisation needs just one tool. What has proven itself is the combination of an AI employee for daily work and a secure interface for automations.

    For property managers we recommend the pragmatic setup; applicant dossiers with credit reports only run through the Swiss pipeline.

    What data protection requires

    Property managers face no sectoral AI supervision, but the DPA applies. Most data in the industry is not legally sensitive personal data, as SVIT itself notes; exceptions include religion or, in some cases, marital status. Central is the manager's role: they usually act on behalf of the property owner or the condominium owners' association, which the SVIT model identifies as the controllers. An AI provider is therefore a sub-processor whose engagement the owner must approve in advance (Art. 9(3) DPA). Tenant selection is also delicate: fully automated decisions trigger a duty to inform (Art. 21 DPA), and wilfully breaching it is a criminal offence for the responsible person; on top, a language model can infer origin from names, although the application form may ask for nationality only in exceptional cases.

    • Delete the dossiers of rejected applicants immediately after the letting, including from AI histories, knowledge bases and logs (unless the person explicitly requests further processing)
    • Tenant selection: AI may summarise and pre-sort applications, but a human decides on selection and rejection; for any ranking, hide names and define the criteria in advance
    • Use photos of an occupied flat only with the current tenant's written consent, also for AI-generated listing texts or image editing
    • AI phone assistant: inform callers at the start; call recordings without consent can fall under Art. 179ter of the Criminal Code
    • Records of processing activities maintained under Art. 12 DPA
